II. Methods of Providing Contributions and Their Handling
Providing Contributions
Contributions are provided by Providers to the Recipient through the web portal www.lisrec.com operated by the Lisrec Endowment Fund. These are in particular the following methods of providing contributions:
- Donation. By providing a donation, i.e., crediting a financial contribution to the relevant account under the conditions set out herein, a donation agreement is concluded, the content of which is the donation of a contribution to the Recipient by the Provider and the acceptance of this contribution by the Recipient, whereby these Terms form part of the donation agreement.
- Public Collection. At the moment of crediting the contribution to the account of the web portal www.lisrec.com, it is deemed that a contribution has been made to a specific public collection organized by the Recipient, as specified by the Provider.
A written donation agreement for individual donations is not automatically provided or generated by the portal. The Provider shall provide, along with the contribution, all required information necessary for transferring his/her contribution to the Recipient, or for sending it to a specific public collection, or information that he/she wishes to have stated on the donation confirmation. This includes, in particular, the identification of the Provider and the identification of the specific support (public collection), usually in the form of a variable symbol that the Provider finds on the website www.lisrec.com. The relationships arising from the processing of personal data by the Lisrec Endowment Fund within the Recipient’s user account as the controller of personal data will be governed by a separate agreement containing rules on the processing of personal data. The Recipient undertakes to regularly (annually) publish an annual report including the financial part, which is publicly available on the Recipient’s website.
By providing a contribution, the Provider also confirms that he/she has read these Terms, accepts them, and provides the contribution in accordance with them. The Provider also confirms that all data provided about himself/herself are true, that he/she is the one who provided the contribution, and that he/she is the rightful recipient of the donation confirmation for tax purposes.
By providing a contribution, the Provider further declares that the funds provided originate from legal sources.
The Provider acknowledges that by providing a contribution, he/she does not acquire any rights to use the trademarks, trade names, company logos, or other objects of intellectual or industrial property of the Lisrec Endowment Fund, the Recipients, or other persons.
Contributions may be provided by the Provider through one of the payment channels available within the web portal lisrec.com, in particular:
- payment by bank transfer to the operator’s account Lisrec Endowment Fund
- payment by online payment card
- payment by fast transfer
- payment via Google Pay
- payment via Apple Pay
Handling of Contributions
The Lisrec Endowment Fund accepts contributions provided through the lisrec.com portal into a special account separate from other funds and keeps them in this account until they are handled in accordance with these Terms.
The Lisrec Endowment Fund is bound by the Provider’s instructions regarding the intended support.
If it is a regular donation made by card, the Provider may terminate the existing regular donation in his/her personal profile at www.lisrec.com (if registered), or send a request to terminate the donation by email to donate@lisrec.com. A regular donation made by bank transfer must be terminated directly by the donor in his/her internet banking.
Donation Confirmation
The value of the donation or contribution to a public collection may be deducted from the tax base provided that the conditions of Act No. 586/1992 Coll., on Income Taxes, as amended (the “Income Tax Act”), are met.
Upon request, the Lisrec Endowment Fund will send the Provider an email confirmation of the contribution provided, including a notice of the possibility to use the confirmation for tax purposes.
Conditions for natural persons, including employees (§ 15 para. 1 of the Income Tax Act): Natural persons (including employees) may deduct the value of donations from the tax base if the total value of donations in the tax period (calendar year) exceeds 2% of the tax base or amounts to at least CZK 1,000. In total, a maximum of 30% of the tax base may be deducted for the years stipulated by the current legislation. Self-employed persons apply the deduction in their tax return. Employees who file their own tax return apply the deduction in the same way as self-employed persons. Employees whose tax settlement is processed by their employer submit the donation confirmation to their payroll office once a year, no later than 15 February, for the entire previous year.
Conditions for legal entities (§ 20 para. 8 of the Income Tax Act): Legal entities may deduct the value of donations from the tax base if the value of the donation is at least CZK 2,000. In total, up to 30% of the already reduced tax base may be deducted according to current legislation. This deduction cannot be applied by taxpayers who are not established or incorporated for business purposes.
